Legislation in the realm of art

Abstract
Legislation—the establishment of general, normative, and binding rules—is one of the functions of governance, and governments employ this instrument to regulate social relations and to achieve their goals, objectives, and "ideals." The question that arises is whether art can also be the subject of legislation; and if the answer is affirmative, to what extent should such general rule-making extend?
In the domain of legislative policy on art, we must acknowledge that the principle is non-intervention by the state in establishing rules, unless the public interest in such intervention outweighs the harm of non-intervention by the governing authority. Likewise, the legislator must accept that the realms of "freedom" in the field of art should be broader than the controlled domains, and that legislative restrictions on art should not be so extensive as to fall under the principle that "excessive specification is abominable" (takhṣīṣ al-akthar mustaqbaḥ).
In terms of the scope of governmental involvement in legislating on art, certain principles must be accepted by regulatory bodies, including that legislation on art should place greater emphasis on "protection," with the protective aspects of law-making being highly prominent. Furthermore, the principle of "ex post facto control" in art should ensure that prior restraints are minimized as much as possible. Based on the principle of "flexibility," the domain of art is not suited to rigid and inflexible laws. Additionally, according to the principle of hearing, the "participation" of art practitioners in the formulation, interpretation, and implementation of laws is vital—especially at the stage of legislative initiative, where the absence of artists' involvement may expose the relevant law to significant challenges.
