Abstract
Literary and artistic creations are products that emerge from individual creativity within the mind and contain an explicit or implicit message from their creator to others. With the advent of technology for the mass production and reproduction of intellectual products into social and economic life, intellectual and artistic work transformed into a valuable and economic activity. In light of this, the question arose as to what is the legal nature of intellectual creations in the economic domain and what is the appropriate method of protecting them. The present article attempts, by reviewing the literature on the subject, to identify the subject matter and examine solutions compatible with jurisprudential literature. Ultimately, through an analysis of the issue, it first examines the contents of the relevant legal rule and then investigates its legitimacy within the structure of the Islamic legal system.
