Thus, this inquiry aims to investigate the intricate relationship between art and freedom in contemporary society, highlighting the inherent limitations and unattainability of absolute freedom in the ideal of cinema. Contemporary societies often regard cinematic creation as a unique form of human activity and artistic expression, deserving of either more conservative or tolerant treatment. However, when subjected to legal scrutiny and the real-world experiences, art loses its privileged status. In other words, different countries may impose restrictions on the freedom of expression for filmmakers under specific circumstances. This research uses descriptive-analytical method and is based on library studies, which examines instances where the freedom of expression for filmmakers has been limited; it will consider national laws, international regulations, the judicial practices of national courts, and decisions made by the European Court of Human Rights. In conclusion, governments treat the freedom of expression of filmmakers, like any other freedoms, subjecting to special limitations such as security concerns, public morality, and privacy. At times, these restrictions and conditions imposed on the freedom of filmmakers can be even more stringent compared to other fundamental rights. حق آزادی بیان هنری از حق برخورداری از هنر و حق مشارکت در زندگی فرهنگی جدایی‌ناپذیر تلقی می‌شود، که به طور برجسته در ماده 27اعلامیه جهانی حقوق بشر ذکرشده است. این نوشتار درصدد آن است که رابطه پیچیده میان هنر و آزادی در جوامع معاصر را که در چارچوب آرمان هنر سینما به سمت مطلق بودن و عدم امکان مطلق بودن آزادی راه می-برد، درک نماید. نقطه آغاز این مساله آن است که در واقع، جوامع معاصر تمایل دارند آفرینش سینمایی که شکل خاصی از فعالیت انسانی و آزادی هنری است را مستحق برخورد ویژه، محافظه‌کارانه‌تر و یا متساهل‌تر بدانند؛ ولی وقتی هنر از رهگذر صافی قانون، تجربه و آزموده می‌شود، دیگر، از چنین جایگاه ممتازی برخوردار نخواهد بود و به تعبیری دیگر کشورها ممکن است آزادی بیان سینماگران را در مواردی تقویت و در مواردی محدود نمایند. این نوشته توصیفی-تحلیلی و مبتنی بر مطالعات کتابخانه‌ای، به استقرای موارد محدودیت آزادی بیان سینماگران مبتنی بر برخی قوانین ملی و نیز قواعد بین‌المللی و رویه قضایی محاکم ملی و دیوان اروپایی حقوق بشر خواهد پرداخت. نتیجه آنکه، دولتها با آزادی بیان سینماگران مانند هر آزادی دیگری، رفتار می‌کنند که دارای محدودیت‌های ویژه‌ای از جمله امنیت، اخلاق عمومی و حریم خصوصی است و حتی گاهی در معرض قیود و شروطی به مراتب سخت‌تر از سایر حقوق اساسی قرار می‌گیرد. https://el.itaihe.ac.ir/article_705672_f2e9b305f93e05186d1cbc45a3c9d4ec.pdf
